Terms and Conditions for the sale of photography prints


An Equal Share is dedicated to providing you with beautiful, long lasting fine art photography prints that help raise funds to support the empowerment of indigenous people and local communities around the world. 50% of the net sale of the prints you buy will be donated to projects identified on our website. The terms and conditions by which we sell our prints are set out below in English.

1. Some definitions

These terms and conditions set out your legal rights and responsibilities; our legal rights and responsibilities; and provide some key information required by law.

We, us or our” means An Equal Share Photography, (Company Number 15509824).

 “Our site or our website” means the site on which these terms and conditions are displayed. www.equalsharephotography.com

“A print” means a fine art photography print.

“Terms” means these terms and conditions of sale as updated from time to time;

 “You or your” means the person, above 17 years of age (or below with parents’ consent), visiting our site to purchase fine art photography prints from us.

The details of these Terms will not be filed with any relevant authority by us.


2. Terms and conditions of sale

2.1. These Terms apply to all the fine art photography prints displayed on our website 

“Limited edition” A print, limited to a maximum edition of 250 worldwide all sizes included. Each limited edition print is inspected, hand signed and marked with the edition type and number by Stevie Mann, photographer.

“Open edition” A print of unlimited edition. Each open edition print is inspected and hand signed. 

When buying fine art photography prints on our site you agree to the following terms and conditions and all the documents referred to therein. 

3. Description of the prints

    1. To view the images displayed on our website and access print descriptions, click on an image category then on the image you would like information about. A description will appear on the side of the image including:
  1. The title and date
  2. Brief information about the subject.
  3. A drop down menu will provide you with size options in millimetres, the edition run. The size is indicative of the size of the paper size only. The image sits within a white border.
  4. The frame is our customer’s responsibility and the size of the frame would need to be added to that of the print when considering wall space.
  5. The price of the print is indicated when a size option is selected. 
    1. Once you have made an order for a print, an email will be sent to you. Please check carefully that you have selected the desired size and price (see clause below)
    2. According to the law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 we must provide you with key information before a legally binding contract between you and us is made.  
    3. We endeavour to ensure that the information on our website is accurate and up to date. In the unlikely event that an error has been detected in the information provided once you have submitted your order, we will contact you. Any changes would have to be agreed by you prior to the order being completed.


4. Ordering the print (s)

4.1 You can place and order on our website by doing the following:

  1. Click on the image you would like to purchase from our website www.equalsharephotography.com, 
  2. Select the size (displayed in mm) and with corresponding price
  3. Select the number of items
  4. Once selection is made, the print will be added to your basket
  5. Proceed to check out and enter the required payment information.
  6. The purchase will be completed by clicking Pay Now.
    1. Please check your order carefully. If you need to amend any information, you can do so before submitting the order to us.
    2. When you have placed your order (once the payment is confirmed), we will acknowledge your order by Email. Please note that this acknowledgement does not mean that your order has been accepted.
    3. We reserve the right to reject your order. This is  unusual and may be due to the following reasons and not limited to these:
  1. the print is unavailable
  2. the payment is not authorized
  3. we have noticed a mistake in the pricing or information about the print.
    1. Once your order is accepted, your will receive an email confirming your order with an order number (Confirmation Email ). At this point, your order will start to be processed. 
    2. By purchasing a print, you are confirming that you have read the print description, and selected the appropriate edition type and size as required by you.
    3. Once your order is accepted, we enter in a legally binding agreement.


5 Cancellation 

5. 1 You have the right to cancel the order within 14 days without giving any reason. 

    1. The right to cancel within 14 days does not apply on print orders that were customised specifically for you.
    2. If you decide to cancel the order, this needs to be clearly stated in an email sent to sales@equalsharephotography.com before the expiry of the 14 day period. Please make sure that the email is acknowledged by us. If it has not been acknowledged, please resend it.  
    3. To meet the cancellation deadline, it is sufficient for your email to be sent before the cancellation period has expired.
    4. If it has been delivered, the print needs to be sent back before the 14 day period expires.
    5. The cancellation period will expire 14 days from the day on which you acquire physical possession of the print. 
    6. We reserve the right to cancel your order should payment of the full value of the print fail.
    7. Without limitation to any provisions relating to Limitation of Liability, we will not be liable or otherwise responsible for any loss or damage caused to you by the cancellation of an order by us.

 

6. Effects of cancellation

    1. If you cancel the order before receiving the print, we will refund you the full amount of the print right away.
    2. If the order is cancelled after the print has been shipped or after reception of the print, the refund is conditional to the print being sent back to us, at your own cost, or handed back to us no later than 14 days after the print has been received, and being in good condition.
    3. If you cancel your order in accordance with these Terms, we will re-fund you the full price of the print.
    4. The print will be refunded once received and checked for any damage. We will not be able to refund a print that has been damaged in any way when handled by you as we would not be able to sell the print again, and this would negatively affect the projects supported by An Equal Share.
    5. Once the print has been received and checked, we will ensure that the refund is made to you without undue delay, and no later than 15 days after the day we receive the print back from you.
    6. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless we mutually agree otherwise.
    7. An Equal Share Photography is charged a transaction fee when your order is complete which is non-refundable, this fee will be passed on when processing any refund due to cancellations.

7. Damaged prints and refund policy

    1. Should you receive a print in damaged packaging which may affect the integrity of the print, refuse to accept the print and notify us of the issue with photographic evidence. This is essential for us to take the issue to the carrier or post.
    2. Should you notice the print is damaged after reception, please notify us of the damage, with photographic evidence within 24h (unless unavoidable circumstances) of receiving the print and we will replace the print as per your order without charge.

8. Print delivery

    1. Typically, the time of delivery from the date ordered is on average 8-10 weeks. We will  do our best to reduce this where possible. 
    2. The delivery address and contacts will be copied as per the information provided to us. Please make sure that your contact details are accurate and complete. If you notice any errors after submitting your order, please inform us via email and ensure that this email has been acknowledged.
    3. If the carrier or post cannot deliver the print because of an incorrect address then we reserve the right to charge an additional supplement, where additional costs are incurred.
    4. The prints are delivered rolled in protective packaging, in a tube and will not fit in a letter box. Please take this into consideration when choosing delivery options.
    5. We will not take any responsibility for any loss or damage that occurs due to the print delivered in a ‘safe place’ instructions.
    6. If nobody is available to take delivery, please contact us so we can inform the courier company.
    7. It is your responsibility to arrange for re-delivery or collection from your local post office/depot if you are out when the goods are delivered, all delivery details will be provided. 
    8. Prints returned to us by the carrier because delivery was not possible  no contact has been made within the time scales stated will be subject to a re-delivery charge at our standard rate.
    9. The print will be considered delivered and accepted once you have received the print and not informed us of any damage within 24 hours of reception. 
    10. Damage which happens after the successful delivery of the print/s including during framing or mounting will be your responsibility. No refunds will be provided. Any replacement required will be subject to payment of the printed price on the website.

9. Payment

    1. Prices displayed on our website are for prints only, delivered rolled in a tube.
    2. Delivery costs are additional as indicated at the check out.
    3. Prices will be updated from time to time.
    4. We accept the following means of payment: visa, mastercard, and American Express with the exception of some countries. https://stripe.com/payments/features#cards
    5. We will do all we reasonably can to ensure that all of the information you give us when paying is secure by using an encrypted and safe payment mechanism. However, in the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
    6. Your card will only be charged when you confirm your order.
    7. Nothing in this clause affects your legal rights to cancel the order during any applicable ’14 day ‘ period detailed under the Clauses entitled ‘Cancellation ‘ and ‘Effects of Cancellation ‘ above.
    8. The price of the goods:
  1. is in pounds sterling (£)(GBP);
  2. includes VAT at the applicable rate; and
  3. does not include the cost of delivery. Delivery options and costs will be provided before you place your order.

10. Nature of the prints

    1. As stated in  The Consumer Rights Act 2015 we will ensure that the prints are of satisfactory quality and match the description in our website.
    2. All images on our website are intended to be an indicative preview of the final output and should not be relied upon as a completely accurate representation of the final product
    3. All sizes and measurements set out on our site are as accurate as possible, but there may be small variances.
    4. The colours are displayed accurately on our site, the actual colours that you see on your computer may vary depending on the monitor used..
    5. The prints are printed on Hanhemule paper with archival ink. We provide prints that will last a lifetime if handled and cared for appropriately. Please do not position your print  in direct sunlight as this will affect its integrity in time. No refund will be provided for sunlight damage.

11. Copyright and ownership

    1. By purchasing a print from us, you understand that you own a copy of an original photograph as captured by the original creator, Stevie Mann.
    2. At no point do you, or will you, own the copyright of any image purchased from us as a print.
    3. Prints may not be reproduced, copied, shared electronically or used for any commercial purposes without our prior, express, permission and any applicable fee (as determined by us) being paid.
    4. It is illegal to produce copies of any work which is copyrighted by us, and we reserve the right to request legal assistance to enforce any applicable laws should any breach of copyright be discovered.

12. Complaints

12.1 Should you need to contact us regarding products which you are not completely satisfied please email sales@equalsharephotography.com. We will respond to all complaints as soon as possible.


13. Limit on our responsibility

    1. We are not responsible for any delay or failure in carrying out our duties under this Agreement if the delay or failure is caused by circumstances beyond our reasonable control including but not limited to strikes, lock-outs or other industrial action by third parties, natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
    2. If an event outside of our control takes place that affects the performance of our obligations under this contract we will contact you as soon as reasonably possible to notify you; and
    3. Where the event outside of our control affects our delivery of your print to you, we will arrange a new delivery date with you after the event outside of our control is over

14. Damage and claim

    1. Your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’),  are   set out at the top of these Terms. They are a summary of your key rights. 
    2. Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’). You may also have other rights in law.


15. Jurisdiction and Dispute Resolution

    1. These terms are governed by the laws of England and Wales.
    2. We will try to resolve any disputes with you quickly and efficiently.
    3. If you are unhappy with the print, or our service, please contact us as soon as possible.
    4. If we cannot resolve a dispute between you and we, we will let you know and consider the need for Alternative Dispute Resolution.
    5. If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to these Terms
    6. These Terms are current and up to date as of: 31st March 2024
